Here are some examples of the types of cases that have been handled by Miller & Ogorchock, SC in Milwaukee, Wisconsin.
Industrial/defective product accident in Kenosha, Wisconsin, resulting in two deaths
This was a very complex products liability case that resulted in a settlement in excess of $1 million for our client, the surviving spouse of one of the deceased workers.
Automobile accident case with lower back injury, with two subsequent back surgeries
This case was tried to a Waukesha County jury recently and resulted in a $900,000 jury verdict. The issues were complex, involving significant vocational issues. Our client was a tool and die maker, and was unable to return to work because of his injuries.
Automobile accident in Door County, Wisconsin
Our client, an Illinois resident who was vacationing in Door County, sustained a significant low back injury in a medium impact auto accident. Issues in the case involved the injuries sustained by our client relative to the speed of impact. Our client had a lower back surgery following the accident. The case settled prior to trial for a significant amount of money.
Automobile-pedestrian accident
Our client was cutting grass in the course of his employment with a municipality. The defendant driver fell asleep, leaving the roadway and hitting our client, who sustained significant personal injuries, including brain injuries. This case is ongoing. To date, our client has received the insurance policy liability limits from the defendant driver’s insurer, and the limits of our client’s underinsured motorists coverage. This case was recently argued before the Wisconsin Supreme Court in our effort to access an additional $1 million for our client, pursuant to an umbrella insurance policy that did not include underinsured motorists benefits, but, for various factual and legal reasons, we have argued that it should have included that coverage.
Numerous cases against life insurers who denied insurance policy benefits to our clients, the beneficiaries of the life policies after the deaths of loved ones.
Insurance companies refused to pay, alleging a failure to disclose prior health conditions on life insurance applications. In all cases, insurer eventually paid the full policy limits to our clients.
Automobile accident in which our client was an elderly, retired woman who suffered a significant hip fracture in the accident.
The insurance company took a harsh stance in the case, arguing that our client was not as disabled as her doctors said she was, and that, since she was retired, her case was not worth as much as if she was a working person. We rejected all offers, and tried the case before a Milwaukee County jury, obtaining a significant verdict.
Dog Injury case in Waukesha County
Our client was injured while walking her dog when another, unleashed dog approached our client and her dog in the street. This caused our client’s dog, protecting her owner, to charge at the unleashed dog causing our client to fall and sustain an injury. We and our client obtained a very favorable jury verdict in Waukesha County. Although our client’s injuries were not catastrophic, the case was very important to her, and we won a $40,000 verdict.
